This policy describes how Lexi Browser collect, process, use and share information about you.

This Privacy Policy applies to all of Lexi Browser's games, whether on your computer, mobile device, website, console, PC or platform including Facebook (each a "Game" and collectively the "Games") ). It also applies to our marketing and advertising campaigns on all platforms and other services we may provide to you from time to time. In this Privacy Policy, we refer to our games, websites, marketing and advertising campaigns, and other services collectively as our "Services."

By downloading, accessing and/or playing our games or other services, you agree to the use of your information in accordance with this Privacy Policy. If you have any concerns about providing information to us or using it as described in this Privacy Policy, you should not use our games or other services.

The information we collect from you depends on the context in which you provide it and use our Services. For example, we collect information when you create an account, interact with other users, upload images to our servers, request customer support, sign up to receive newsletters, participate in surveys or otherwise communicate with us. The types of information we may collect include your username, password, email address, photos, and any other information you choose to provide.

2. Information We Collect Automatically When You Use the Services

When you access or use our Services, we automatically collect information about you, including:

a) Usage Information: We collect information about your use of our Services, including gaming service ID, levels completed, game scores, time spent using our Services, and other game play information.

b) Log Information: We log information about your use of our Services, including your browser type and language, access times, pages viewed, your IP address and the website you visited before navigating to our Services.

c) Hardware Information: We collect information about the computer or device you use to access our Services, including the hardware model, operating system and version, browser mobile network information, list of other BNEI mobile applications installed on the device, MAC address, IP address International Mobile Equipment Identity (“IMEI") number and other unique device identifiers made available by the operating system of your device.

d) Location Information: We may collect information regarding the geographic location of your device each time you use the Services provided on iOS or Android platforms or otherwise consent to the collection of this information. You may withdraw consent for the collection of platform provided location data using the settings on your device. Your location is stored for the period specified in the Services before collection.

e) Information Collected by Cookies and Other Tracking Technologies: We use various technologies to collect information (which may include personal information), and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your computer hard drive or in device memory that help us to improve our Services and your experience, see which areas and features of our Services are popular and count visits.

f) Profile Information: We create profiles based upon your preferences, characteristics, behavior and other information from your use of the Services, and with your consent, we combine that information with information from other sources.

3. Information We Collect From Third Parties

We may also obtain information from other sources as far as it is necessary to perform our Services, and combine that with information we collect through our Services. For instance, we may collect game ranking and achievement status from your console or mobile operating system game center application. We also obtain publicly available information from social media monitoring service platform. If you create or log into your BNEI account through a third-party platform (such as Facebook or Twitter), we will have access to certain information from that platform, such as your name, birthday, and profile picture, in accordance with the authorization you give to such platform. Additionally, when you complete in-app purchases, we may collect information about you from the provider of your device operating system when they process the purchases on our behalf. Please note that we do not receive your payment method information from the operating system providers. In other cases, we will ask you to authorize us to collect, store, and use personal information from third parties.

2. How we use your information

We use your personal and non-personal information, both individually and in aggregate, in the following ways:

To operate our business and to enhance and personalize your game experience, including to:

Operate, improve, and develop our games and services;

Populate online leaderboards and enable online challenges;

Help you find your friends or tell your friends about a product;

Facilitate sharing on social networks;

Serve and measure the effectiveness of advertising;

Measure the health of our services;

Provide game experiences customized to your preferences;

Facilitate your gameplay on multiple devices, when available;

Identify, fix, and troubleshoot bugs and service errors;

Provide software updates;

Save game progress and stats;

Adhere to your preferences and to deliver dynamic content; and

Help keep our services safe and fair, resolve disputes, investigate and help curb fraud and illegal behavior, comply with the law, and to enforce our agreements and policies.

To provide you support, including to:

Help identify and troubleshoot problems with your account or games;

To survey your opinions through surveys or questionnaires;

Communicate with you and respond to your specific requests or questions; and

Manage and send you confirmations and important information about your products.

To personalize our communications with you, including to:

Present offers or information relating to games you might like;

Make recommendations to you; and

Personalize advertising for you and deliver targeted marketing, service updates and promotional offers.

We uses analytics services to understand how users engage with our products. Our analysis relies on your consistent device identifier, or identifier for vendor (IDFV) on Apple devices, so that we can track your behavior over time and develop an understanding of how you prefer to interact with our products. If you have more than one our product installed on your device, those products may share the same identifier value. This enables us to develop an understanding of how you engage with all of our products you have installed. The identifier value is provided to us through the operating system on your device. In the course of processing your data, we may do any of the following:

Analyze your behavior in our products over time;

Analyze your behavior in aggregate;

Combine your information with the information of other players to create anonymized aggregate reports that allow us to understand large-scale behavior trends;

Analyze your information to understand how well our products perform on your device or to investigate bugs, crashes, and other technical issues;

Combine your information with the information of other players to create customer segments based on behavior in our products or location-based behavior;

Use analysis of your behavior in our products to provide you with customized gameplay experiences;

Use your device identifier to enroll you in an A/B test. An A/B test is a type of simple behavioral experiment wherein groups of users are provided with slightly different experiences in our products so that we can research and analyze which of the experiences is the most compelling to users of our products; and

Analyze your behavior in the context of an A/B test.

European Economic Area (EEA) Only:

Per requirements under the EU’s General Data Protection Regulation (GDPR), we log your consent state for compliance purposes. This information is stored on servers hosted in the EU and is used solely for GDPR compliance. Your device identifier is stored along with your consent status. If you consent to personalized advertising, your device advertising identifier also is stored in case we need to be able to access it to assist you with data portability or erasure requests. Your device advertising identifier is not stored in our consent logging database if you do not consent to personalized advertising.

3. How we may disclose your information

We may share information about you as follows or as otherwise described in this Privacy Policy:

• With other users of our Services;

• In response to a request for information if we believe disclosure is in accordance with any applicable legal requirement;

• If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property and safety of SYBO or others;

• In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company; and

• With your consent or at your direction.

We also may share aggregated information or otherwise anonymised information, which cannot reasonably be used to identify you.

4. Age Limit

We do not knowingly collect or solicit personal data about or direct or target interest based advertising to anyone under the age of 13 (or the age otherwise defined under applicable law) or knowingly allow such persons to use our Services.

If you are under 13, please do not send any data about yourself to us, including your name, address, telephone number, or email address.

No one under the age of 13 may provide any personal data.

If we learn that we have collected personal data about a child under age 13, we will delete that data as quickly as possible.

If you believe that we might have any data from or about a child under the age of 13, please contact us via Customer Service.

5. Retention

We retain your data for as long as your account is active or as needed to provide you the Service.

Note that if you ask us to remove your personal data, we will retain your data as necessary for our legitimate business interests, such as to comply with our legal obligations, resolve disputes, and enforce our agreements.

The personal data you provide to us is stored on servers located in secure facilities and is protected by protocols and procedures designed to ensure that such data complies with industry standard security, such as firewalls and data encryption. However, no server, computer or communication network or system, or data transmission over the Internet, can be guaranteed to be 100% secure. Therefore, while we strive to protect your personal data, we cannot ensure or warrant the security of any personal data you transmit to us or through the Services.

By using the Services or providing us with Personal Data, you agree that we may communicate with you electronically regarding security, privacy and administrative issues related to your use of the Services. If we learn that a security system has been breached, we may attempt to notify you electronically by posting a notice on the Service or by sending you email.
